���Ķ���vlog leverages the Amazon Bedrock, Anthropic API and Mistral platforms to deliver cutting-edge Large Language Model (LLM) capabilities for the ���Ķ���vlog product. We use a combination of these services to ensure the highest level of security, privacy, and service across regions.

AI services are region-specific to meet data residency and compliance requirements:

• For customers in Australia, all AI features use the Amazon Bedrock, Anthropic API and Mistral OCR services. Your prompts and results are retained only in Australia and are not stored overseas.‍
• For customers in the United States and North America, all AI features use the Anthropic API, Mistral OCR and Amazon Bedrock services. Your prompts and results are retained only when required to comply with law or combat misuse.

• For customers in the rest of the world, AI features are delivered with a combination of Amazon Bedrock, Mistral OCR and the Anthropic API. We maintain strong privacy and security principles to ensure that your data is not shared with additional parties.

Regarding training of models, no prompts or responses in the ���Ķ���vlog platform are used for training of AI models.

1. Introduction

These AI Product Terms (AI Terms) apply to Customer (Customer, you, your) use of any artificial intelligence-powered features, functionalities, tools, or services made available by ���Ķ���vlog Australia Pty Ltd (���Ķ���vlog, we, us, our) through our Web Platform (AI Products).

By enabling, accessing, or using the AI Products, you agree to these AI Terms. If you do not agree, you must not use the AI Products.

The AI Products are offered as optional features that may form part of, or be accessible through, the Products and Services as defined in ���Ķ���vlog’s Terms and Conditions (the ���Ķ���vlog Terms).

These AI Terms apply in addition to, and prevail over, the ���Ķ���vlog Terms to the extent of any inconsistency relating to the AI Products.

These AI Terms are incorporated by reference into, and form part of, the ���Ķ���vlog Terms.

These AI Terms are intended to clarify the ownership, use, risks, and responsibilities relating to the AI Products by:

1. confirming that use of the AI Products is optional and at your sole discretion and risk;
2. disclaiming all warranties and liability for AI-generated content;
3. requiring you to ensure that your use of the AI Products complies with applicable laws and these AI Terms; and
4. clarifying that ���Ķ���vlog does not make any commitments, guarantees, or indemnities in relation to the AI Products.

Capitalized terms used in these AI Terms have the meaning given to them in the ���Ķ���vlog Terms unless otherwise defined below.

2. Defined Terms

For the purposes of these AI Terms, the following additional definitions apply:

Input means any data, information (including Personal Information), content, or material submitted, uploaded, or otherwise provided to the AI Products by you or your Authorized Users.

Output means any content, data, material, or information generated by the AI Products in response to or based on the Input.

3. Ownership, License and Use of Input and Output

3.1 Ownership of Input and Output

You retain all rights, title, and interest, including all Intellectual Property Rights, in and to the Input you provide to the AI Products.

As between you and ���Ķ���vlog, you also own all rights, title, and interest in the Output generated by the AI Products based on your Input, subject to these AI Terms and the ���Ķ���vlog Terms.

3.2 Licence to ���Ķ���vlog

By providing Input and using the AI Products, you grant ���Ķ���vlog anon-exclusive, worldwide, royalty-free, irrevocable, perpetual, and transferable license to:

1. access, use, process, store, reproduce, and otherwise use your Input and Output solely to provide, operate, and support the Products and Services, including for security, maintenance, diagnostics, and service-level improvements, operational improvements, for so long as you use our Products and Services or necessary to provide and support the Products and Services; and
2. use the Input and Output to comply with Law and enforce the Terms.

For clarity, this licence does not permit ���Ķ���vlog or its AI Technology Partners to use your Input or Output for training or otherwise developing Large Language Models.

3.3 Sharing with Third Parties

You acknowledge and agree that ���Ķ���vlog may share Input and Output with its service providers, affiliates, and authorised third parties where necessary to provide the AI Products or to comply with Law.

Any such third parties will be bound by appropriate confidentiality and security obligations.

Any sharing will remain consistent with the regional data residency requirements described in clause 5.3 and will be limited to AI Technology Partners as necessary to provide the AI Products.

3.4 Your Responsibility for Input

You are solely responsible for the accuracy, legality, and appropriateness of your Input and for ensuring that you have all rights, permissions, and consents necessary to submit Input to the AI Products.

You must not submit any Input that includes sensitive personal information (including data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health data, or data concerning your sex life or sexual orientation).

4. Restrictions on Use

4.1 Prohibited Use of Input and Output

You must not, and must ensure that your Authorized Users do not, use the AI Products to:

1. submit Input or use Output that infringes any person’s Intellectual Property Rights, privacy rights, or other legal rights;
2. submit Input that includes sensitive personal information;
3. use Output in a way that is misleading, deceptive, or likely to cause harm;
4. violate any applicable Law or third-party terms;
5. generate, disseminate, or rely on Output for professional advice, including legal, medical, financial, or other regulated advice;
6. use the AI Products for fully automated decision-making without human oversight;
7. use the AI Products to create or disseminate false, defamatory, harassing, or offensive content, or content that may cause harm to individuals or entities; or
8. use the AI Products to violate the Law.

4.2 Disclosure Requirement

If you share Output publicly, you must clearly disclose that the content is AI-generated in a manner that is easily visible and understandable to recipients.

4.3 Content Sharing and Publication

When publishing or disseminating Output (including via social media, websites, reports, or presentations), you must:

1. manually review and verify each Output before sharing;
2. attribute the content to your name or entity;
3. not present Output as human-generated without disclosure;
4. not use Output to impersonate or mislead.

5. Output Limits and Technology Partner Disclosure

5.1 Limits on Output Volume

���Ķ���vlog may impose reasonable limits on the volume, frequency, or nature of Output you or your Authorized Users can generate using the AI Products. These limits may include usage caps, rate limits, or restrictions based on your Subscription Plan. ���Ķ���vlog will notify you of any such limits via the Web Platform or by direct notice.

5.2 AI Technology Partners

���Ķ���vlog uses third-party AI technology providers to enable the AI Products, including Large Language Models and machine learning services. By using the AI Products, you acknowledge that your Input (including any personal information you choose to include) may be shared with such third-party providers solely to provide, operate, and improve the AI Products, in accordance with ���Ķ���vlog’s Privacy Policy.

5.3 Data Handling and Privacy

���Ķ���vlog will handle your Input and Output in accordance with the Terms, these AI Terms, and ���Ķ���vlog’s Privacy Policy.

(a) Australia: For customers in Australia, all AI features use the Amazon Bedrock service. Your Input and Output will be processed and retained only in Australia and are not stored overseas. Consistent with our AI Technology Partners’ practices, such data is not retained indefinitely and is automatically deleted within defined retention periods (in accordance with our AI Technology Partners’ retention policies typically within 30 days or less).

(b) United States and North America: For customers in the United States and North America, all AI features use the Anthropic API and Amazon Bedrock service. Your Input and Output will be processed and retained only in the United States and are not stored overseas. Consistent with our AI Technology Partners’ practices, such data is not retained indefinitely and is automatically deleted within defined retention periods (typically within 30 days or less).

(c) Rest of World: For customers in all other regions, AI features are delivered through a combination of the Amazon Bedrock service and the Anthropic API. We maintain strong privacy and security principles to ensure your Input and Output is not shared with additional parties, and that it is not retained indefinitely but deleted within defined retention periods (typically within 30 days or less).

Under ���Ķ���vlog’s agreements with its AI Technology Partners, they are not permitted to use your Input or Output to train their underlying Large Language Models.

6. No Professional Advice Disclaimer, Authority Disclosure, and Feedback

6.1 No Professional Advice

The Output is generated by artificial intelligence systems and is provided for informational purposes only. ���Ķ���vlog makes no representations or warranties as to the accuracy, completeness, reliability, or fitness of the Output. The Output does not constitute legal, financial, medical, or other professional advice. You are solely responsible for reviewing, verifying, and determining the suitability of any Output for your intended use.

6.2 AI Limitations

You acknowledge that AI systems, including the AI Products, may:

1. struggle to understand context or nuances of language;
2. lack human judgment, emotions, and empathy;
3. perpetuate biases or errors inherent in training data;
4. generate Output that is factually inaccurate, incomplete, or impersonal; and
5. face challenges with complex reasoning and decision-making.

These limitations are inherent to AI technology. You must evaluate and verify all Output before relying on it or sharing it.

6.3 Prohibition on Fully Automated Decision-Making

You must not use the AI Products to make decisions that have legal or similarly significant effects on individuals without appropriate human oversight. This includes, without limitation, decisions relating to employment, credit, insurance, housing, or legal matters.

6.4 Disclosure to Authorities

���Ķ���vlog may disclose your Input and Output to law enforcement, regulatory authorities, or third parties if ���Ķ���vlog reasonably believes such disclosure is necessary to:

1. comply with applicable Law, court order, or government request;
2. respond to a claim or allegation that the Input or Output infringes rights or violates Law;
3. investigate or address any suspected unlawful or prohibited use of the AI Products; or
4. protect the rights, property, or safety of ���Ķ���vlog, its Personnel, other customers, or the public.

���Ķ���vlog is not required to notify you of any such disclosure where prohibited by Law, or if ���Ķ���vlog reasonably considers that providing notice would undermine the purpose of the disclosure.

6.5 Feedback Mechanism

���Ķ���vlog welcomes feedback regarding the AI Products. You may submit feedback through the Web Platform or other channels notified by Mastt. Any feedback you provide may be used by ���Ķ���vlog to improve the AI Products and will not be treated as confidential.

6.6 Disclaimer

To the maximum extent permitted by Law, ���Ķ���vlog excludes all liability for any Loss, damage, claim, cost, or expense arising out of or in connection with your use of the AI Products or any Output, including any errors, inaccuracies, omissions, or malfunctions of the AI Products or Output.

You acknowledge and agree that:

1. you use the AI Products and any Output at your own risk;
2. ���Ķ���vlog does not warrant or guarantee the accuracy, completeness, reliability, or fitness for purpose of any Output; and
3. you are solely responsible for verifying and determining the suitability of any Output for your intended use.
